Chair, Litigation, Tax, and Creditors' Rights & Foreclosure Practice Groups

  • Daniel (“Dan”) Barham is the co-founder of Barham & Maucere LLC, a full-service law firm with national scope where he manages the firm and leads the creditor rights, foreclosure, and litigation practices. Dan’s individual practice has evolved over time – starting with state and local tax law to a full-scale creditor rights practice. Today, Dan is licensed in many jurisdictions (state, federal, and bankruptcy courts), and his clients include investors, entrepreneurs, and loan servicers. He personally represents the firm’s clients in foreclosure litigation, non-judicial foreclosures, and in administrative law and regulatory matters. He is a vigorous advocate, and especially enjoys defending note investors and servicers against frivolous FDCPA and consumer law claims.

    Dan graduated from Texas A&M University with a bachelor’s degree in Business Administration and holds a law degree from Vanderbilt University Law School. Dan resides in Nashville, Tennessee, but frequently represents his clients in court across the country. Dan spends his free time outdoors where he enjoys hunting and fishing with family, friends, and clients.

  • Scott Maucere is a lawyer and entrepreneur. He founded his first company at age 24, and successfully exited his legal tech startup PUSHTOSTART in 2019. He is a founding partner and chief legal officer at Barham & Maucere LLC, a boutique business law firm with offices in Nashville, Chattanooga, and Columbus. Mr. Maucere focuses his practice on structuring complex investment and commercial deals, advising early-stage high growth companies across the country, and private placement securities offerings. Mr.Maucere also has experience litigating complex business matters. Mr. Maucere is a Superlawyer’s Rising Star and speaks on investment, intellectual property, and other legal topics.

    Scott is admitted to several federal courts, including the US Court of International Trade, US Court of Appeals for the Federal Circuit, US Court of Appeals for the 6th Circuit, and the US District Courts for the Northern District of OH, Western District of NY, Northern District of GA, Eastern District of TN, Middle District of TN, and the Northern District of TX.

Litigation Practice Group, Focus on Liquor and Distillery Law

  • Zachery “Zach” Darnell is a litigation associate with Barham & Maucere where he handles a variety of litigation matters but with an emphasis on commercial litigation and construction law. Zach is licensed in Florida and Tennessee, along with various Federal jurisdictions. Zach prides himself on his client advocacy and enjoys fighting on behalf of his clients.

    Zach graduated from the University of West Georgia with a major in political science and a minor in economics and holds a law degree St. Thomas University School of Law. Zach currently resides in Ringgold, Georgia with his wife and dog. In his free time, Zach enjoys cooking, hiking, and camping with his friends and family.

Transactional and Tax Practice Groups

  • Originally from Memphis, Tennessee, Kelly graduated in 1993 from Rhodes College with a B.A. in economics. He earned his J.D. from the University of Memphis School of Law in 1998. Kelly completed his education at New York University where he received a Master of Laws (LL.M.) in Taxation in 1999. Kelly began his legal career in Hilton Head Island, South Carolina, where his practice focused primarily on estate planning and tax matters. He also practiced in Atlanta, Georgia, and Murfreesboro, Tennessee, where his areas of practice expanded to include estate and trust administration, guardianships and conservatorships, as well as various business matters, including choice of entity and other organizational issues, strategic tax planning, and transactional matters. At Barham & Maucere, Kelly has further broadened his practice to include judicial and non-judicial foreclosures, creditor litigation and defense, and general legal research and writing in support of all the firm’s practice areas. He is licensed to practice law in Tennessee, South Carolina, Georgia, and Michigan. Kelly lives in Murfreesboro, Tennessee, with his wife, Lauren, and their two children, Ella and George. He is an avid soccer fan, coaching his children in their youth leagues, and even playing himself when he gets a chance.

Crystal M. Henry

Associate

Foreclosure, Creditors Rights, and Litigation Practice Groups

  • Crystal Henry is an associate attorney with Barham & Maucere, where she focuses her practice on creditor rights, investor litigation and defense, and judicial and non-judicial foreclosure. Crystal attended Middle Tennessee State University, where she was a member of the Mock Trial team, and graduated with a B.S. in Political Science and Psychology. Crystal earned her J.D. from Belmont University College of Law, where she was a member of the Board of Advocates Moot Court team.

    When she’s not at the office, Crystal is a Professor of Paralegal Studies at Nashville State Community College. She teaches a variety of legal topics, including Legal Writing, Property Law, and Legal Ethics. Crystal grew up in Brentwood, Tennessee and currently resides in Nashville with her husband, Matt, and their dog, Vinny. In her free time, Crystal enjoys practicing yoga, cheering on the Tennessee Titans and the UT Vols, and travelling anywhere with a beach.
